This Privacy Policy does not govern the information Customers collect about Clients within the Services when SwiftCharting is acting as a service provider to the Customer. In those cases:
- Our handling of Client information is controlled by our agreements with Customers, including our Terms of Service and, where applicable, our HIPAA Business Associate Agreement (“BAA”) (collectively, the “Agreement”).
- If there is a conflict between this Privacy Policy and the Agreement, the Agreement controls to the extent of the conflict.
- SwiftCharting generally has a limited relationship with Clients of Customers. If a Client contacts us about their information, we will respond as required by applicable law and may direct the Client to the Customer (the organization responsible for the Client’s information in the context of the Customer’s practice).

For purposes of this Privacy Policy, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked (directly or indirectly) with an individual or household.
